Conditions of sale
PREAMBLE
These general conditions of sale apply between,
on the one hand, SARL Distrilaine, owner of the online sales site: www.laine-et-tricot.com, hereinafter referred to as “Distrilaine” and,
on the other hand, non-commercial individuals wishing to make a purchase on the Distrilaine website, hereinafter referred to as the “Customer”.
“Distrilaine” and the “Client” are collectively referred to as “the Parties”.
The Parties agree that the applicable general conditions of sale are those made available to the Customer on the website www.laine-et-tricot.com when placing the order.
If a condition were to be lacking, it would then be governed by the practices in force in the distance selling sector in France. Distrilaine reserves the right to modify these general conditions of sale according to the evolution of the law and the jurisprudence in force in France. Nevertheless, the general conditions of sale will be those applied at the time of the order.
OBJECT
These general conditions of sale define the contractual relations between the parties and in particular the placing of the order, payment, confirmation of the order and delivery.

THE ORDER
The user has the option of placing his order from the online catalog (there is no paper catalog).
He will be able to choose his items directly on each page and indicate the desired quantity. His order is accessible via the basket at the top of the page. The order is the subject of a summary which includes the elements specific to the products subject to the order. Once the basket is displayed, the customer can either:
- validate your order by choosing your payment method;
- change the quantity of an item;
- delete an item, by updating the order;
- completely delete the order.
The Customer must provide a valid delivery address - in the event that the address provided does not allow the correct delivery of the order, resulting in its return, the reshipment of the package will be the responsibility of the Customer.
Validation of the order constitutes unreserved acceptance of the special conditions of sale specific to each of the products subject to the order (name, price, color, weight, quantity, particularity of the products).
The customer acknowledges having read and accepted the fixed amount relating to delivery costs.
It is also stipulated that the sales contract is only formed upon validation of full payment of the order with our bank. Once the payment has been validated, Distrilaine will send confirmation of the order by email to the address provided by the Customer.
In the event that a product is no longer available for sale, Distrilaine undertakes to immediately notify the Customer by email, who will have the option to request, within 7 days, the replacement of the product with another of their choice at an equivalent price or to be reimbursed for the amount of the price of the missing product.
The Customer is prohibited from reselling the products. Any order placed by a Customer is for personal use or for the personal use of the person in whose name the delivery is to be made.
The customer is solely responsible for the actual payment of the products purchased and the contact details provided for delivery.
DELIVERY
Distrilaine undertakes to deliver the items ordered as quickly as possible, and within a maximum period of 30 days, postmark being proof.
The package is sent to the delivery address provided by the Customer - in the event that the address provided has not allowed the correct delivery of the order resulting in its return, the reshipment of the package would be the responsibility of the Customer.
For France, the products will be sent by So Colissimo, LettreMax (for small accessories) or Colissimo France - Home Delivery Against Signature.
For another destination, the products will preferably be sent by “Colissimo tracking with signature”.
The Customer will have delivery to the address registered at the time of ordering.
“Distrilaine” cannot be held responsible for any delivery problems, loss or damage to packages which would be the responsibility of La Poste or ColiPoste.
In the event of loss or damage, an investigation will be requested from La Poste or ColiPoste; in the event of compensation (depending on the service provider's T&Cs), it will be returned to the customer in the form of a credit or refund.
In the case of a package indicated as "delivered" by ColiPoste, and which the recipient has not received, the Post Office in this specific case is acting in very bad faith and will not recognize its responsibility under any circumstances. Thus it will not grant any compensation, even if it is at fault.
If you would like to add insurance, please request this when ordering.
Upon receipt of the order, the Customer must check its contents and report any errors or missing items within 5 days via the contact form; Distrilaine will then carry out a check.
PAYMENT TERMS
The customer may pay for their purchases using the following methods:
- Bank card (via Paypal module or online banking interface)
- Check
- Payment
- Ideal (for Belgium & Netherlands)
If payment is made by Paypal, the Customer must enter their contact details and credit card information on the secure Paypal site. If the Customer already has a Paypal account, they can pay directly with their Paypal account. They will then receive confirmation of their order by email.
If payment is made by check, the Customer must send payment to: Laine et Tricot - 16 rue Arago - 44240 La Chapelle sur Erdre - France.
It is not necessary for the Customer to send a copy of the order with his check - just on the back of the check the invoice number.
Payment on delivery (cash on delivery) is not offered.
Customers guarantee that they are fully authorized to use a bank card or check and that these provide access to sufficient funds to cover all costs related to placing an order on the laine-et-tricot.com website. Only persons legally capable of entering into contracts concerning the goods and services offered on the site may order on the laine-et-tricot.com website.
PRICING
The prices displayed on the site are in EUROS and are inclusive of all taxes (TTC). The amount of taxes is 20 percent. Distrilaine will issue the Customer an invoice showing the amounts excluding tax (HT) and including tax.
The price of the items is as mentioned on the site.
It is increased by the amount of the delivery costs which will appear following the order; this amount depends on the amount of the order and the country of delivery.
SHIPPING COSTS
Shipping costs are flat rate and include transport, packaging and preparation.

RIGHT OF WITHDRAWAL
In accordance with Article L 121-20 of the Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of his order to exercise his right of withdrawal. In the event of using this right, the Customer must return his purchase intact, in its original packaging, at his own expense - in particular, the purchase must not have been in contact with a smoking environment, which would make it impossible to resell it.
The right of withdrawal cannot be exercised for magazines, damaged, opened, stained or spoiled items and wool that has been balled up at the customer's request.
The return should preferably be made by tracked Colissimo; in the event of loss of the package, Distrilaine cannot be held responsible.
Distrilaine will reimburse the Customer no later than 14 days following the date of withdrawal, by default by the same means of payment as that chosen when ordering (or any other method of reimbursement if this is specified in the return package).

In accordance with Article L 121-20-2 of the Consumer Code, the right of withdrawal cannot be exercised for any supply of goods made according to the Customer's specifications or clearly personalized. Consequently, the Customer will not be able to exercise his right of withdrawal for any order of products made at the request of said Customer.
Return of items outside the withdrawal period
Beyond the 14-day withdrawal period, if you wish to return items, you have 30 days from receipt of your package to return part of your order to us.
The items must have been kept in their original packaging, not have been opened or used. The items must have been stored in a non-smoking environment or away from any odors. Laine et Tricot reserves the right to assess whether the return complies with these criteria or not.
The Customer must return the items at their own expense and may request a credit or a refund of the amount of the returned items.
No exchange possible.
Return of articles due to an error on our part
If this should happen, please contact us , we will send you by email a Colissimo return voucher to print and stick on the return package of the items - you will not have to pay anything and we will send you the Items in accordance with your order.
Please note, you must notify us of any errors within 5 days of receiving your package.
Defective items
In the case of a defective item (wool or needles), please send us an email with a description of the problem and specifying your invoice number.
If the product is found to be faulty, we will send you a new item - in the majority of cases, you will not need to return the faulty item to us.
For wool, the claim must reach us within 5 days of receipt of the package.
RESPONSIBILITY
Distrilaine is not responsible for errors in information transmitted by the Customer when ordering.
The products sold on the website www.laine-et-tricot.com are presented with the greatest possible precision. However, the Parties agree that the global networks constituting the Internet are complex, have unequal transmission capacities, as well as their own usage policies, no one can guarantee the proper functioning of the Internet as a whole. Consequently, Distrilaine cannot, in particular, be held responsible for technical failures due to third parties likely to alter the quality of colors, texts, sounds, images and the conditions of accessibility to the website www.laine-et-tricot.com.
Distrilaine makes every effort to facilitate Internet users' access to its online sales site, to secure the pages and information on its site, especially financial data. However, Distrilaine cannot be held responsible by its Customers and/or any Internet user who wishes to access its site for the risks associated with the use and navigation of the Internet and in particular viral attacks (viruses, worms, Trojan horses), phishing (sending an email to an Internet user inviting them to connect to a site that is a perfect copy of a site known or unknown to the Internet user and to request confidential information) and any other form of external intrusion or possible fraud through the use of the networks constituting the Internet.
GUARANTEES
Distrilaine guarantees that the products offered on its site in the "ethical wools" section are from fair trade.
Distrilaine controls the quality of the products sent by its producers. However, Distrilaine cannot guarantee the quality of all the products sent to it without risking damaging, altering the products themselves as well as their packaging. Consequently, Distrilaine cannot guarantee that the balls of wool and cotton and other products offered on the site are completely free of defects.
The products offered by Distrilaine on its site, in particular balls of wool and cotton, may be hand-made and dyed in an artisanal manner (no baths). Distrilaine cannot therefore guarantee the perfect match of the colors, dimensions and weight of the balls offered for sale.
FORCE MAJEURE
Distrilaine may not, under any circumstances, be held liable for the non-performance, poor performance, or delays in the performance of its contractual obligations, which would be due to the occurrence of:
- a case of force majeure recognized by French law or courts, that is to say one or more unforeseen, irresistible events beyond the control of Distrilaine;
- a fortuitous event; conventionally constitute fortuitous events, and this, in a non-limiting manner, a stoppage of energy supply, an interruption of the electricity or telecommunications network, a strike by EDF staff, the data center or the Parties to the contract, a governmental or legal restriction, etc.
In the event that the force majeure or unforeseeable event lasts for more than 30 days, this contract may be terminated by the Customer, without prior notification and without compensation.
INTELLECTUAL PROPERTY
The site www.laine-et-tricot.com is the exclusive property of SARL Distrilaine, and governed by French law, whose head office is located at 16 rue Arago - 44240 La Chapelle sur Erdre.
The general architecture, content, live and still images, sounds, processes, products and all other elements that are part of the website are the exclusive property of Distrilaine and its suppliers.
Any total or partial use, copying, reproduction, publication, downloading, display, transmission or distribution of this site without the authorization of Distrilaine is prohibited and will be considered as an infringement of the provisions of the French Intellectual Property Code, subject to being expressly authorized by law.
EVIDENCE
Distrilaine will systematically confirm your order and then its shipment by email.
For any payment by check, sending the voucher summarizing the entire order signed manually by the Customer will constitute proof of the sales contract.
For any payment by bank card, validation of the payment by our bank will be considered proof of the sales contract.
For any amount greater than one hundred and twenty (120) euros, in accordance with article L. 134-2 of the Consumer Code, Distrilaine will archive proof of the written conclusion of the sale on paper or electronic media.
ENTIRETY
Any clause deemed null and void by a change in law or case law will be considered unwritten. This will not change the validity of the other clauses of the general conditions of sale herein.
APPLICABLE LAW AND JURISDICTION
These conditions are subject to French law and particularly to law n°2004-575 on confidence in the digital economy.
These general conditions of sale apply to the whole of France as well as to the whole of the European Union to the extent of compliance with the specificities of the legislation in force in each of the member countries.
Any dispute arising between the Parties under this contract shall, in the absence of an amicable agreement, be subject to the jurisdiction of the Commercial Court of the place of domicile of the defendant. French law shall apply.
COMPUTING AND FREEDOM
The information requested on the website www.laine-et-tricot.com is necessary for the registration and tracking of your order.
In order to respect your privacy, the information you send us is in no case transferred, sold or rented to other companies or organizations.
In accordance with the Data Protection Act No. 78-17 of 6 January 1978, as amended, the data recorded on the site www.laine-et-tricot.com has been declared to the CNIL under number 1229475.
In accordance with this same law, you have the right to modify, oppose, rectify and delete data concerning you. You can exercise this right by writing to SARL Distrilaine -16 rue Arago, 44240 La Chapelle sur Erdre.
