These general conditions of sale apply between, 
on the one hand the SARL Distrilaine owner of the online sales site: hereinafter referred to as "Distrilaine" and, 
on the other hand, non-commercial individuals wishing to make a purchase on the Distrilaine site, hereinafter referred to as the “Customer”.

“Distrilaine” and the “Customer” are collectively referred to as “the Parties”.
The Parties agree that the applicable general conditions of sale are those made available to the Customer on the site when placing the order.

If a condition were to be lacking, it would then be governed by the practices in force in the distance selling sector in France. Distrilaine reserves the right to modify these general conditions of sale according to changes in the law and case law in force in France. Nevertheless, the general conditions of sale will be those applied at the time of the order.

These general conditions of sale define the contractual relations between the parties and in particular the placing of the order, the payment, the confirmation of the order and the delivery.

The user can place his order from the online catalog (there is no paper catalog).

He can choose his articles directly on each page and indicate the desired quantity. His order is accessible via the basket at the top of the page. The order is subject to a summary which includes the elements specific to the products covered by the order. Once the basket is displayed, the customer can either: 
- validate his order by choosing his method of payment;
- change the quantity of an item;
- delete an item, by updating the order; 
- delete the order in its entirety.

The Customer must provide a valid delivery address - in the event that the address provided did not allow the proper delivery of the order resulting in the return thereof, the reshipment of the package would be the responsibility of the Customer.

The validation of the order implies unreserved acceptance of the special conditions of sale specific to each of the products covered by the order (name, price, color, weight, quantity, particularity of the products).
The customer acknowledges having read and accepted the fixed amount relating to the delivery costs.
It is also stipulated that the sales contract is only formed from the validation of the full payment of the order with our bank. Once the payment has been validated, Distrilaine will send the order confirmation by e-mail to the address provided by the Customer.

In the event that a product is no longer available for sale, Distrilaine undertakes to immediately notify the Customer by e-mail, who will have the possibility of requesting, within 7 days, the substitution of the product by another of its choice of equivalent price or to be reimbursed the amount of the price of the missing product.

The Customer is prohibited from reselling the products. Any order placed by a Customer is for personal use or for the personal use of the person on whose behalf the delivery is to be made. 
The customer is solely responsible for the effective payment of the products purchased and the contact details transmitted for delivery.

Distrilaine undertakes to deliver the items ordered as quickly as possible, and within a maximum period of 30 days, postmarked as proof.

The package is sent to the delivery address provided by the Customer - in the event that the address provided did not allow the correct delivery of the order resulting in its return, the reshipment of the package would be at the Customer's charge.

For France, the products will be sent by So Colissimo, LettreMax (for small accessories) or Colissimo France - Delivery Against Signature at Home.
For another destination, the products will preferably be sent by "Colissimo followed with signature".
The Customer will be delivered to the address registered at the time of the order.

“Distrilaine” cannot be held responsible for any delivery problems, loss or damage to packages which would be the responsibility of La Poste or ColiPoste. 
In the event of loss or deterioration, an investigation will be requested from La Poste or ColiPoste; in the case of compensation (according to the T&Cs of the service provider), it will be paid to the customer in the form of a credit note or reimbursement. 

In the case of a package indicated "delivered" by ColiPoste, and which the recipient has not received, the Post Office in this specific case is showing very bad faith and will in no case recognize its responsibility. Thus it will not grant any compensation, even if it is in the wrong. 

If you wish to add insurance, please request it when placing your order.

Upon receipt of his order, the Customer must check its contents and report any error or missing item within 5 days via the contact form; Distrilaine will then carry out a verification.

The customer can pay for their purchases by the following means: 
- Bank card (via Paypal module or online banking interface)
- Check
- Payment
- Ideal (for Belgium & Netherlands)

If payment is made by Paypal, the Customer must enter their contact details and bank card information on the secure Paypal site. If the Customer already has a Paypal account, he can pay directly with his Paypal account. He will then receive a confirmation of his order by e-mail.

If payment is made by check, the Customer must send payment to: Laine et Tricot - 16 rue Arago - 44240 La Chapelle sur Erdre - France. 
It is not necessary for the Customer to send a copy of the order with his check - just on the back of the check the invoice number.

Payment on delivery (COD) is not offered.

Customers guarantee that they are fully authorized to use a bank card or check and that these provide access to sufficient funds to cover all costs linked to placing an order on the website. Only people legally capable of entering into contracts concerning the goods and services offered on the site can order on the site.

The prices displayed on the site are in EUROS and are inclusive of all taxes (TTC). The tax amount is 20 percent. Distrilaine will issue the Customer with an invoice showing the amounts excluding tax (excluding taxes) and including tax.

It is increased by the amount of delivery costs which will appear following the order; this amount depends on the amount of the order and the country of delivery.

In accordance with article L 121-20 of the Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of their order to exercise their right of withdrawal. If this right is used, the Customer must return their purchase at their own expense, intact, in its original packaging - in particular the purchase must not have been in contact with a smoking environment, which would make a new one impossible. marketing.

In accordance with article L 121-20-2 of the Consumer Code, the right of withdrawal cannot be exercised for any supply of goods made according to the Customer's specifications or clearly personalized. Consequently, the Customer will not be able to exercise his right of withdrawal for any order of products made at the request of said Customer.

Return Items outside the withdrawal period

Beyond the 14-day withdrawal period, if you wish to return items, you have 30 days from receipt of your package to return part of your order to us.

The items must have been kept in their original packaging, must not have been opened or not have been used. The items must be stored in a non-smoking environment or away from any odor. Laine et Tricot will reserve the right to assess whether the return complies with these criteria or not.

The Customer must return the items at his own expense and may request a credit or a refund of the amount of the items returned.

Return Items following an error on our part

If this should happen, please contact us , we will send you by e-mail a Colissimo return slip to print and stick on the return package of the items - you will not have to pay anything and we will send you back the Items conforming to your order.

Please note, you must notify us of any error within 5 days of receipt of your package.

Defective Items

In the case of a defective item (wool or needles), please send us an e-mail with the description of the problem and specifying your invoice number.
If the product is found to be faulty, we will send you a new item - in the majority of cases you will not need to return the faulty item to us.
For wool, the complaint must reach us within 5 days of receipt of the package.

Distrilaine is not responsible for errors in the information transmitted by the Customer when ordering.
The products sold on the site are presented with the greatest possible precision. However, the Parties agree that the global networks constituting the Internet being complex, having unequal transmission capacities, as well as specific usage policies, no one can guarantee the proper functioning of the Internet as a whole. Consequently, Distrilaine cannot, in particular, be responsible for technical failures caused by third parties likely to alter the quality of colors, texts, sounds, images and the conditions of accessibility to the site 

Distrilaine makes every effort to facilitate Internet users' access to its online sales site, to secure the pages and information on its site, especially financial data. However, Distrilaine cannot be held responsible by its Customers and/or any Internet user who wishes to access its site for the risks linked to the use and navigation on the Internet and in particular viral attacks (virus, worm, Trojan horse) , phishing (sending an email to an Internet user inviting him to connect to a site that is a perfect copy of a site known or unknown to the Internet user and to request confidential information) and any other form, external intrusion, possible fraud through the use of networks constituting the Internet.

Distrilaine guarantees that the products offered on its site in the "ethical wool" section come from fair trade. 
Distrilaine controls the quality of the products sent by its producers. However, Distrilaine cannot guarantee the quality of all the products sent to it without risking damage or alteration of the products themselves as well as their packaging. Consequently, Distrilaine cannot guarantee that the balls of wool and cotton and other products offered on the site are completely free of defects.
The products offered by Distrilaine on its site, in particular the balls of wool and cotton, can be hand-made and dyed in an artisanal way (no baths). Distrilaine cannot therefore guarantee the perfect match of colours, dimensions and weight of the balls offered for sale. 

Distrilaine cannot, under any circumstances, be held responsible for non-performance, poor performance, or delays in the performance of its contractual obligations, which may be due to the occurrence of:
- a case of force majeure recognized by French law or courts, i.e. one or more unforeseen, irresistible events beyond the control of Distrilaine;
- a fortuitous event; conventionally constitute fortuitous events, and this, in a non-limiting manner, a stoppage of energy supply, an interruption of the electrical or telecommunications network, a strike of the personnel of EDF, the data center or of the Parties to the contract, a government or legal restriction...

In the event that force majeure, or a fortuitous event, lasts for more than 30 days, this contract may be terminated by the Customer, without prior notification and without compensation.

The site is the exclusive property of SARL Distrilaine, and governed by French legislation whose head office is located at 16 rue Arago - 44240 La Chapelle sur Erdre.
The general architecture, content, live images and still images, sounds, processes, products and all other elements that are part of the website are the exclusive property of Distrilaine and its suppliers.

Any total or partial use, copy, reproduction, publication, downloading, display, transmission or distribution of this site without the authorization of Distrilaine is prohibited and will be considered an infringement of the provisions of the French Code of Intellectual Property, subject to be expressly authorized by law.

Distrilaine will systematically confirm your order and then its shipment by email. 
For all payment by check, sending the voucher summarizing the entire order signed manually by the Customer will serve as proof of the sales contract.

For any payment by credit card, the validation of the payment by our bank will have value of proof of the sales contract.

These conditions are subject to French law and particularly to law no. 2004-575 for confidence in the digital economy.
These general conditions of sale apply for the whole of France as well as for the entire European Union to the extent of compliance with the specificities of the legislation in force in each member country.

Any dispute arising between the Parties, within the framework of this contract, will, in the absence of an amicable agreement, fall within the jurisdiction of the Commercial Court of the place of domicile of the defendant. French law will be applied.
